Probate matters are handled in Probate Court. Each county has a Probate Court. Most people know that the estate of a deceased person goes through probate.
Most people generally know that upon a person's death the Probate Court is usually involved in handling the estate of that deceased person. Did you know that if there are little or no assets in the deceased person's name at the moment of their death chances are there will be no probate of that person's assets? If there is less than $40,000 in assets in the deceased's name there is a short cut path through Probate Court to get those assets to the family without going through the full 6 to 9 months of court supervision? We have the knowledge to advise you of all the in's and out's of the probate experience, both before death to avoid Probate Court and after the death of a loved one to make the task of handling the assets of the deceased as worry free as possible
However, did you know that other matters are subject to the jurisdiction of Probate Court? We have experience with both Conservatorships and Guardianships.
A Conservatorship arises when a person cannot handle their financial affairs due to age (under age 18 or otherwise incapacitated), mental and/or physical (inability) incapacity.
A Guardianship arises when a person cannot physically or mentally take care of themselves due to age (under age 18 or otherwise incapacitated), mental and/or physical (inability) incapacity.
As a general rule, Probate Court requires a lawyer. You cannot represent yourself. Lawyer's fees are generally governed by law and/or approved by the Probate Court.
